In preparation for the hearing, city officials have been advised to make revisions to current sand dredging plans of the pool area.
A new Superior Court Judge, Timothy Taylor, has been named to replace Judge Yuri Hofmann. The change required the previously scheduled hearing if October 6 to be moved.
In spite of the time extension, city staff will not be able to present complete dredging plans as of the November date due to the need to consult with the Army Corps of Engineers. The San Diego City Council on September 22 not to certify the current final report, stating that input form the Army Corps of Engineers was needed.
The final report in its current format has been criticized by Councilwoman Donna Frye, having called the report inadequate and made note that the report made no mention of the Children's Pool potentially been turned into an official marine mammal park. The potential for this action is outlined in State Bill 428 which was recently signed into law by the Governor and slated to take effect on January 1, 2010.
City staff plans on presenting the newly assigned judge with a full progress report at the November hearing.
